update on permission request

I regret to inform you all that my chosen band for my music video piece are no more........ they're not dead they just broke up as they are lacking in a lead vocalist although they have made assurances to their fans on their Facebook page they are yet to reform-

"We are sad to announce that Dan Kidney has left the band to pursue other interests. We shall continue as a band and are beginning a search for a new vocalist. If you're interested message dynamitehero@live.co.uk for more details. 

We will be back soon with new tracks and shows as soon as possible."

My e-mail request to the band regarding the use of their music was never replied i must assume that they are no longer checking their band email and are no longer actively functioning as a group therefore copyright isn't so much of an issue. So i shall proceed with the video as planned and address a copyright problem if one arises.
